By accessing or using Turnout ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Turnout is a scheduling and membership management platform designed for volunteer fire and EMS organizations. We provide tools for shift scheduling, member management, document tracking, and related organizational needs.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Upload or transmit viruses, malware, or other malicious code
• Use the Service to send spam or unsolicited communications
• Impersonate any person or entity or misrepresent your affiliation

5. Subscription and Payment

Turnout offers free and paid subscription plans. For paid plans:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice

6. Data Ownership and Rights

You retain all rights to the data you upload to the Service ("Your Data"). By using the Service, you grant us a limited license to store, process, and display Your Data solely to provide the Service to you. We do not claim ownership of Your Data.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide advance notice when possible.

8. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your account if:

• You violate these Terms of Service
• You fail to pay applicable fees
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

9. Limitation of Liability

To the maximum extent permitted by law, Turnout shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
